General terms and conditions (GTC)

Constant Sanitär GmbH (“Constant Sanitär & Elektro”), Durisolstraße 1, 4600 Wels, FN 603765 s. Applicable to all orders and services unless otherwise agreed in writing.

§ 1 Scope

These GTC apply to all contracts between Constant Sanitär GmbH (contractor) and the customer (client) for works in plumbing, heating, climate, electrical and photovoltaics.

§ 2 Conclusion of contract & quotations

Quotations are non-binding unless expressly stated otherwise or an acceptance period is set. The contract is formed by written order confirmation or by commencement of performance.

§ 3 Scope of services & cooperation

The scope of services is defined in the order confirmation or agreed schedule. The client shall provide access to the site, power and water and any necessary information in good time.

§ 4 Prices & payment

Prices are as stated in the quotation plus statutory VAT. Changes and additional work are charged separately. Invoices are due within the agreed period (typically 14 or 30 days) without deduction. Default interest may be charged at the statutory rate.

§ 5 Warranty

Statutory warranty rights apply. For defects we are entitled to remedy (repair or replacement). The warranty period is two years from handover unless otherwise agreed.

§ 6 Liability

Our liability is limited to intent and gross negligence and to breach of essential contractual obligations to the extent permitted by law.

§ 7 Applicable law

Austrian law applies. Place of jurisdiction for disputes is Wels, where permitted.
